Terminology

Store — the online marketplace at sweetsmoke.com.ua where the User can Order Goods delivery to the specified physical address. The store is not the direct seller, but only provides the User with information about the Product and then routes incoming Orders to the Supplier.

Supplier — a person who has the legal right to trade in Goods and performs a direct delivery and sale to the User.

User — a person who has used the website Store to Order the Product.

Goods presented on the store site, items or services provided by the Provider via the Internet.

Personal information — name, contact number, delivery address and other personal information the User voluntarily transmitted them to the Shop and necessary for the performance of the Store and the Supplier of his duties under this Agreement.

Contract — the legal relationship arising between the User and the Shop in Order and purchasing Goods in the framework of this Agreement. These relations arise from the moment of confirmation of the Order in the Store.

Order — a request for purchase of Goods issued by the user via the electronic form provided on the website of the Store.

Services — actions taken by the Store and Supplier to implement the provisions of the Contract.

General provisions

1.1. All interactions between the user, the retailer and the Supplier shall be on the terms of this Agreement.

1.2. All the clauses of the Agreement based on the Ukrainian legislation, including laws "About Zahist rights spozhivachiv".

1.3. If you experience between the Store/Supplier and the User of any disputes regarding the Contract or the provisions of this Agreement, they will be addressed in the framework and on the basis of the legislation of Ukraine.

1.4. The store may subject the Agreement to any change in its sole discretion and without notice to the User. The changes come into effect from the date of posting the revised Agreement on this Internet page.

1.5. Making a reservation on the website of the Store is a confirmation of his full agreement with all clauses of this Agreement.

The Services Of The Store

2.1. Shop — information resource, and not trading. The services of the Store are to inform the User about available Products and their Suppliers. Personal User data specified when placing the Order, are sent to the Provider (end seller), which performs the direct supply and sale of Goods.

2.2. The shop acts as an information intermediary and is not a guarantee of performance of the Agreement by the Provider (the end seller).

Obligations Of The User

3.1. When Ordering, the User must fill in all provided in electronic form field by providing accurate information that would be required to Store and Supplier to fulfill their part of the obligations.

3.2. All responsibility for additional costs and/or delays in the delivery of Goods caused by the User has submitted false or incomplete information on his Personal data rests with the User.

Privacy policy

4.1. Store processes and stores Personal data of the User according to the requirements of the law of Ukraine "On protection of personal data".

4.2. To perform their part of obligations under the Agreement, the Store conveys the User's Personal data to the Supplier.

4.3. When Ordering, the User voluntarily agrees to the processing and storage Store their Personal data and their transmission to the Supplier.

4.4. The online shop is not obliged to verify and does not verify the accuracy of Personal data provided by the User. All responsibility for any consequences caused by providing incomplete or inaccurate information lies with the User.

4.5. By submitting your Personal data, the User acknowledges and agrees that his Personal data may be provided to bodies of state power and local self-government within their powers in the implementation of regulatory and fiscal measures.

4.6. In case of disagreement with any paragraph of the section "privacy Policy" User must immediately leave the Store's website. Staying on the Store's website, the User confirms the full consent with all points of this section.

The Sale Of Goods

5.1. To purchase the Goods through Internet Shop the User is obliged to fill out the online Order form, providing relevant, reliable and sufficient information needed by the Store and the Supplier for the performance of their obligations under the Contract.

5.2. If after Ordering the User's Personal data required for the Store and the Supplier for the performance of their obligations is changed, the User shall immediately notify the Shop know about this, by contacting their representative on one of the phones specified in section "Contacts" on the website of the Store. The User bears all responsibility for any costs and delays in delivery of Goods due to change of Personal data of the User and/or late notification.

5.3. Filling out the online Order form and confirming it, the User takes the responsibility to pay for selected Goods, when it can be delivered to the Ordering address.

Delivery

6.1. Delivery to the User is carried out in three ways:

a) delivery service Provider in the city of Kiev;

b) courier service "New Mail" in other inhabited localities of Ukraine;

V) ex warehouse of the Supplier.

6.2. The supplier is obliged to deliver the Goods to the User within 5 working days from the date following the day of Ordering. The exact time of delivery the courier Provider shall coordinate with the user by phone in advance.

6.3. The delivery of Goods by courier "New Mail" regulated by the service (usually 2-3 days). The store and the Supplier is not responsible for the agreement and observance of terms of delivery service "New Mail".

6.4. The user agrees to be at the delivery address on the agreed time and to pay for the Goods. Payment is made in cash in national currency of Ukraine at the hands of the courier.

6.5. Using the services of a courier service "New Mail", the User agrees also to pay for its services on delivery of Goods.

6.6. If a Product is not possible through the fault of the User, the situation is regarded as a failure of the User of the Product. In this case the Contract is terminated and the Goods remain with the Supplier.

Damage and loss of Goods during shipping process

7.1. If the Goods are delivered to the user by the delivery service Provider, the responsibility for its integrity and completeness lies with the Supplier.

7.2. If the Goods are delivered to the User by courier "New Mail" to the transfer of the Goods to the representative of the service "New Mail" responsibility for the integrity and completeness of the Goods lies with the Supplier. From the moment "New Mail" received the Goods for shipment, the responsibility falls on her.

7.3. The shop is not responsible for the integrity and completeness of the Goods.

Return and exchange of Goods

8.1. Before sending the User the Provider is obliged to check the Goods for completeness and absence of defects, defects, mechanical damage.

8.2. In accordance with the provisions of the law of Ukraine "About Zahist rights spozhivachiv", the User has the right to exchange the Goods from the Supplier on the same, if the quality of the Product is adequate, but not satisfied with the color, size or other characteristics of Goods, not allowing it to be used for its intended purpose. This right is reserved for the User 14 days from the day following the day of receipt of Goods.

8.3. In accordance with the provisions of the law of Ukraine "On protection of consumer rights", at identification of shortcomings in the product, the user has the right to contact the Vendor or the Authorized service center and demand:

a) proportional reduction in the cost of Goods (monetary compensation);

b) free eliminate the deficiencies within a reasonable time;

C) reimbursement to address the deficiencies;

8.4. Products from the category of "consumables" (liquid) are returned in undamaged original packaging. Once opened, the Product in this category cannot be returned.

Disclaimer

9.1. When Ordering, the User confirms that he is familiar with all provisions of this User agreement and completely agree with them. If You do not agree with any of the above paragraphs, You must immediately leave the Store's website.

9.2. The store is not the seller or Provider of Goods. The store only provides an information platform where the Provider and the User can find each other.

9.3. The store does not promote Smoking, vaping or hovering, and do not constitute the "safety health" of these classes. The store does not promote the use of "electronic cigarettes and accessories," not claims about the harmlessness and safety of use "of liquids for cigarettes, e-liquids, e-cigarettes and accessories".

9.4. All the information presented on the website is promotional and not a recommendation. The shop is not responsible for how the User interpretirovat and uses this information.

9.5. All Goods presented on the Store website designed for display and sale only to persons older than 18 years. Using the services of the Store, the user agrees to the terms of this agreement and confirms that he was 18 years old. The shop is not responsible for false information about the age, provided by the visitors during the site usage.

9.6. All responsibility for the accuracy of information about the nicotine content or lack thereof in the purchased Goods lies with the Supplier. The shop is not responsible for the inaccuracy provided by the information Provider.

9.7. All the information about the Product and its Provider, published on the website of the Store is provided by the Supplier. The store does not check its accuracy and does not bear for it responsibility.
